ED Cites Kejriwal's Conduct for Arrest in SC Affidavit

In a recent affidavit submitted to the Supreme Court, the Enforcement Directorate (ED) defended its actions against Delhi Chief Minister Arvind Kejriwal, asserting that his "non-cooperative attitude" played a significant role in his arrest. The agency refuted any allegations of malfeasance behind the arrest, emphasizing Kejriwal's conduct as a contributing factor.

ED's affidavit rebutted claims of ulterior motives behind Kejriwal's arrest, asserting that his behavior during the investigation justified the agency's decision. The affidavit highlighted Kejriwal's conduct as instrumental in forming the agency's satisfaction regarding the necessity of his arrest.

The agency dismissed Kejriwal's petition challenging his arrest as lacking merit, citing the exhaustive scrutiny of the evidence by various courts. Referring to Kejriwal's allegations of malfeasance, ED asserted that his contentions were baseless and lacked specificity.

ED further elaborated on Kejriwal's behavior during interrogation, alleging that he displayed evasiveness and non-cooperation, even with simple, non-incriminating questions. Justifying the need for custodial interrogation, ED contended that it would facilitate a more productive questioning process.

The agency criticized Kejriwal for his disregard for the law and non-cooperative demeanor, stating that his behavior hindered effective engagement with the evidence in possession of the investigating officer. Kejriwal's repeated avoidance of summonses, totaling nine instances, further exacerbated the situation, according to ED.

In response to the affidavit, the Aam Aadmi Party (AAP) accused the ED of propagating falsehoods and serving the agenda of the ruling Bharatiya Janata Party (BJP). AAP condemned the agency's actions, alleging that it fabricated lies at the behest of its political masters.

Arvind Kejriwal was arrested on March 21 in connection with a money laundering investigation related to the Delhi excise policy. The Delhi High Court upheld his arrest on April 9, citing his repeated failure to comply with summonses issued by the ED. Kejriwal subsequently appealed to the Supreme Court.

On April 15, the Supreme Court sought a response from the ED regarding Kejriwal's petition, setting the stage for further legal proceedings in the high-profile case.
